WEDDING AND PORTRAIT PHOTOGRAPHY TERMS AND CONDITIONS OF CONTRACT
In the following terms & conditions “The Photographer” shall mean Julia Moxon trading as Julia Moxon Photography and “The Client” shall be those person(s) defined on the reservation form. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by The Client unless such conditions are expressly agreed by The Photographer in writing. By booking with The Photographer directly or through The Photographer’s agent you agree to the below Terms and Conditions.
In these terms words in the singular include the plural meaning and words in the plural include the singular meaning; use of any gender includes the other genders.
Copyright:
When purchasing a digital package The Photographer gives full license to The Client to copy and print the digital images.
When purchasing a prints package the 1988 Copyright Act assigns the copyright of the photographs to The Photographer. It is therefore contrary to the Act, and illegal, to copy printed photographs, or allow to be copied, by any means photographic or otherwise, by any person or machine other than by The Photographer or their appointed agents.
2. Display:
The Client hereby allows The Photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
3. Licenses, Coverage and Reproduction:
Photographs taken under this contract will be at the discretion of The Photographer although every effort will be made to comply with the Client’s requirements.
The Photographer shall be granted artistic license in relation to the poses photographed and the locations used. The Photographer's judgement regarding these matters shall be deemed correct.
The Photographer shall endeavour to photograph all individuals as requested by the Client at some point, but no responsibility will be taken by The Photographer on the occasion of leaving somebody out. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. For a booking involving a religious ceremony or at certain venues, The Photographer's movements are sometimes restricted by the official in charge. The area from which The Photographer is able to cover the ceremony may not be The Photographer's choice and The Photographer cannot accept responsibility for any obstructed view should this be the case.
Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, The Photographer will not be responsible for photographs that are not produced due to technical failure.
4. Prices:
All standard photographic service packages and additional goods specified on the reservation form are supplied at the prices prevailing on the date of reservation. Goods and services not specified on the reservation form are supplied at the prices prevailing at the time of receipt of the order.
5. Payments:
A non-refundable booking fee of 25% of wedding/event photographic package price will confirm The Client’s booking with The Photographer as well as The Client’s full acceptance of these terms and conditions. The booking fee will be deducted from the cost of The Client's chosen package when calculating the final balance due.
Payment of the remaining balance will be due at least eight (8) full weeks before the date of the wedding or event.
Payment must be made in full at time of booking for portrait photographic shoots, gift vouchers, prints and digital media. Full payment will confirm The Client’s booking with The Photographer as well as The Client’s full acceptance of these terms and conditions.
Additional goods other than those originally agreed in the reservation form ordered must be paid for in full at the time of ordering.
Payments must be made via PayPal.
Titles to all goods remains with the Photographer until paid for in full by The Client.
6. Force Majeure:
The Photographer will use reasonable endeavours to put the Client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.
In the event of cancellation by the Photographer, liability shall be limited to a full refund of any fees paid.
In the unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid provided that the total photographic failure has not been caused or contributed to by The Client, his guests, his employees or any other third party. In the event that in the reasonable opinion of the Photographer total photographic failure has been caused or contributed to by The Client, his guests, his employees or any other third party then no refund will be due.
7. Ownership:
All digital negatives (RAW digital files) remain the property of The Photographer and are not available to The Client. If The Client purchases a digital package, The Photographer will supply a JPEG copy of the edited digital files to the Client on a USB stick for The Client’s own non-commercial use. Commercial use of images is only granted when expressly agreed by The Photographer in writing.
8. Cancellation Fees:
If The Client cancels a booking the following cancellation fees will apply immediately:
Cancellation with eight (8) or more full weeks to go until the wedding date, the booking fee of 25% of The Client’s chosen photographic package.
Cancellation with less than eight (8) full weeks to go until the wedding date, full price for the complete photographic coverage booked.
The Client is hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.
Where The Photographer is able to re-book the date with an equivalent booking then the cancellation fee will be reduced to the booking fee.
Gift vouchers for Photographic shoots are non-refundable, non-transferable and non-negotiable. A photographic shoot must be booked and take place on a date before the expiry date of such photographic shoot gift voucher.
9. Product Availability:
In the event of a product being no long available, such as an album, a suitable alternative of similar quality will be offered. The Photographer's choice of an alternative will be deemed as correct and acceptable.
10. Personal Accident:
Any directions issued to the Client, his guests or his employees during a photographic shoot are deemed to be at said person’s own risk. The Photographer cannot be held responsible for any personal accidents during a photographic shoot.
11. Complaints:
In the unlikely event of any complaint with regards to The Photographer’s service or products, all complaints must be received in writing within seven days of collection of products purchased. This includes photographs, albums and frames.
